The parents of Larry Millete allege violations of civil rights and infliction of mental distress in a civil rights lawsuit against Chula Vista and the Chula Vista Police Department (CVPD). 

Benito and Judith Millete allege that the CVPD inflicted “suffered humiliation, severe mental distress, anxiety, and emotional anguish” when a search warrant was executed on May 7, 2021. The lawsuit was first reported by ABC 10’s Zac Self. 

The Millete family claimed that the CVPD also picked up their grandchildren without consent on Sept. 17, 2021. 

According to the complaint, “Plaintiffs were told by the clerk that about 9:00 a.m. police took them. The CCV police officers did not return the three children until 5:30 p.m”. 

“The conduct of the CCV police officers in picking up the grandchildren from their school 16 without consent of the plaintiffs was not only unlawful, but was intentional, extreme, and outrageous conduct,” the complaint read. 

The complaint alleged that the Millete family was wrongfully seized of personal property, which “destroyed many things the plaintiffs owned”. Many of the seized items are still under police custody, according to the complaint. 

“Plaintiffs had ownership or right to the personal property at the time that the CCV police officers converted it as discussed herein, which also includes all electronics such as computers, iPad, heart monitor, and cannon camera,” according to court documents. 

Larry Millete is charged with the murder of his wife, Maya Millete, who has been missing since January 2021. Her remains have not yet been found.
